MANILA, Philippines — A viral image that fueled online speculation that an Office of the Vice President official was secretly receiving instructions while testifying in Vice President Sara Duterte’s impeachment trial has been publicly debunked by the Senate impeachment court’s presiding officer.
Sen. Francis “Chiz” Escudero said Tuesday, September 1, that OVP Assistant Chief of Staff Lemuel Ortonio was not wearing an electronic earpiece when he appeared before the impeachment court.
What could be seen on Ortonio’s ear in genuine images, Escudero said, was a forward-helix ear piercing — not a communications device.
The clarification came after altered images circulated widely on social media following Ortonio’s testimony on August 25 and 26, with some users claiming that the small object near his ear was an earpiece that could have allowed someone to coach him while he was on the witness stand.
Escudero told the impeachment court that the image portraying the object as an earpiece had been verified as AI-generated and was “simply false.”
Inquirer, ABS-CBN News, Philippine News Agency and DZRH separately reported Escudero’s clarification during the September 1 proceedings.
Why the Viral Image Became a Serious Issue
The controversy was more than a social-media sideshow.
Allowing a witness to receive real-time instructions through an electronic device could raise questions about whether testimony was truly coming from the witness’s own knowledge.
Escudero stressed that anyone appearing before the impeachment court must testify independently and without being coached or influenced by lawyers or other individuals.
He also cited foreign court precedents concerning the use of communication-capable devices by witnesses, including earpieces, mobile phones, smartwatches and smart glasses.
Following the controversy, Philippine News Agency reported that Escudero barred communication-capable devices that could potentially be used to transmit information to witnesses during impeachment proceedings.
The precaution means that although the accusation against Ortonio was rejected, the episode still triggered a broader reminder about protecting the integrity of testimony inside the impeachment court.
Who Is Lemuel Ortonio?
Ortonio is an assistant chief of staff and assistant secretary in the Office of the Vice President.
He became a significant witness in the prosecution’s presentation of evidence concerning the OVP’s use of confidential funds.
The prosecution called Ortonio to testify on August 25, and the impeachment court allowed prosecutors to treat him as a hostile witness, giving them wider latitude in questioning him. ABS-CBN News described him as the second hostile witness presented during that stage of the trial.
His testimony extended into August 26 and touched on how confidential-fund transactions and supporting documents were handled inside the OVP.
Philstar reported that Ortonio testified that former Vice Presidential Security and Protection Group commander Col. Raymund Lachica was not formally an OVP employee even though Lachica allegedly played a role in implementing activities funded by confidential money. Ortonio also said he relied on Lachica’s representations while preparing OVP responses to the Commission on Audit.
During questioning the previous day, Philstar reported that Ortonio said he had filed certain protective intelligence reports without reading them and had personally covered a ₱150,000 liquidation shortfall that had not yet been reimbursed at the time of his testimony.
On August 26, Ortonio also confirmed during questioning that Lachica had spent confidential funds handed to him by former OVP special disbursing officer Gina Acosta, according to Philstar’s trial recap.
Those statements — rather than the viral photograph — remain among the substantive issues being examined by senator-judges.

The controversy also illustrates a growing challenge surrounding major political proceedings: images can circulate online far faster than they can be authenticated.
A seemingly minor visual detail — in this case a small piece of metal on a witness’s ear — was enough to generate allegations that Ortonio might have been receiving outside instructions.
But the impeachment court’s clarification dramatically changed the picture.
According to Escudero, the authentic object was jewelry placed on the front cartilage fold of Ortonio’s ear. The version depicting it as an electronic earpiece was not genuine.
That distinction matters because an accusation of covert witness coaching could undermine public confidence in testimony even when the visual “evidence” supporting the allegation turns out to be manipulated.
The Bigger Story Is Still the Testimony
While the earpiece controversy produced a wave of online attention, it does not determine the merits of the impeachment case against Vice President Sara Duterte.
The impeachment court is weighing evidence and testimony involving allegations contained in the articles of impeachment, including matters surrounding the handling of confidential funds.
No finding of guilt should be inferred simply from allegations, testimony or the prosecution’s presentation of evidence. Duterte and her defense team retain the opportunity to contest the allegations and evidence before the impeachment court reaches any final judgment.
For now, one viral mystery has been resolved: according to the impeachment court’s presiding officer, Lemuel Ortonio was wearing a piercing — not an earpiece.
But the questions raised during his actual testimony about how confidential funds were handled remain very much before the court.
