South Korean Court Orders North Korea to Pay $32.5 Million for Liaison Office Demolition

A South Korean court has ordered North Korea to pay 44.6 billion won, or about US$32.5 million, in damages over the 2020 demolition of an inter-Korean liaison office in the North Korean border city of Kaesong.

The Seoul Central District Court issued the ruling on Wednesday, marking the first time the South Korean government has won a judgment in a lawsuit brought directly against North Korea.

The case concerns the inter-Korean joint liaison office, which was established in 2018 as a channel for communication between Seoul and Pyongyang. North Korea demolished the building with explosives on June 16, 2020, as relations between the two sides deteriorated.

At the time, tensions had increased over anti-North Korean leaflets sent across the border by groups of North Korean defectors in South Korea. Pyongyang had condemned Seoul for failing to stop the leaflet campaigns.

The liaison office was empty when it was destroyed because South Korean personnel had left the site earlier amid the Covid-19 pandemic. The explosion also damaged a nearby support facility.

South Korea filed the damages lawsuit in June 2023, seeking compensation for the destruction of government-owned property. The claim was filed shortly before the applicable three-year period for bringing the case was due to expire.

The court’s decision is largely symbolic because South Korea currently has no practical mechanism to force North Korea to pay the compensation. Diplomatic relations between the two countries remain severely strained.

The ruling comes amid a prolonged freeze in inter-Korean relations, with North Korea continuing to expand its military capabilities while maintaining limited engagement with Seoul.

For South Korea, the case establishes a legal judgment concerning the destruction of the liaison office and formally assigns financial liability to North Korea through the country’s judicial system.

Whether the judgment can eventually be enforced will depend on future developments in relations between the two Koreas and the availability of assets or other mechanisms that could be used to collect the awarded damages.
